This Privacy Policy explains how TOBCO, LLC ("TOBCO", "we", "us"), located at 131 Intercontinental Drive, Newark, DE 19713, collects, uses, and protects information in connection with Witness Mark, including our website, SMS program, and subscriptions (the "Service"). By using the Service you agree to this Policy and to our Terms of Service.

1. Information we collect

• Contact information you provide, such as your email address and phone number, and a name if you share one.
• Messages and story activity: the messages you send to the Service and the choices you make in the story, which the Service uses to remember your conversations and personalize your experience.
• Subscription and transaction data. Payments are handled by our payment processor; we do not store full card numbers.
• Referral data, such as your referral code and signups attributed to it.
• Usage and device data, such as pages visited, approximate region, and basic device information, collected through standard web technologies.

2. How we use information

• To provide and personalize the Service: delivering messages, remembering your conversations and preferences, and continuing your story.
• To operate the business: billing, account support, service announcements, and referral rewards.
• For our own marketing: we may use your contact information and the preferences you share to tell you about Witness Mark and other products from our family of brands. We do this ourselves; see Section 4.
• For analytics and story development, using aggregated, de-identified interaction data (for example, which story choices are most popular).
• For safety, security, and legal compliance.

3. Mobile information and text messaging consent

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as our messaging and telecommunications providers, is permitted solely to deliver the Service. All other categories in this Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Your opt-in to our SMS program applies to Witness Mark only. Message frequency varies, and message and data rates may apply. You can cancel at any time by replying STOP to any message, and get assistance by replying HELP or emailing support@thewitnessmark.com. See the SMS program terms in our Terms of Service for the full program disclosures.

4. How information is shared

Witness Mark, operated by TOBCO, LLC, does not sell, rent, or share consumers' personal information, including mobile phone numbers and SMS opt-in and consent data, with third parties or affiliates for their own marketing or promotional purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who provide support services, such as customer service or message delivery, is permitted solely to operate the service. Text messaging originator opt-in data and consent will not be shared with any third parties.

We share information only with:

• Service providers that help us run the Service, such as messaging and telecommunications providers, AI processing providers, payment processors, hosting, and analytics, each bound to use your information only to provide services to us.
• Legal recipients when required by law, to enforce our Terms, or to protect rights and safety.
• A successor entity in the event of a merger, acquisition, or sale of assets, subject to this Policy.

5. Data retention

We keep personal information while your account or subscription is active and as needed for the purposes above, then delete or de-identify it. You may request deletion at any time (Section 6), subject to records we must keep for legal, billing, or security reasons.

6. Your choices and rights

• Texts: reply STOP to any message to opt out of SMS, or HELP for assistance.
• Email: use the unsubscribe link in any marketing email.
• Access, correction, deletion: contact us at support@thewitnessmark.com to request a copy of your information, correct it, or delete it.
• Depending on where you live, you may have additional rights under state privacy laws, such as the right to know, delete, or correct personal information and the right to non-discrimination for exercising those rights. We honor such requests as required by applicable law.

7. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Changes to this Policy

We may update this Policy from time to time. The "Last updated" date above reflects the current version. Material changes will be communicated through the Service.
